Oops I've noticed I've mixed things up here.  The tree is the physical 
sharira.  The bird who eats is the sukshma sharira which enjoys or suffers 
karmaphala and the bird who watches is the atman as sAkShi or as Ishvara.

Sorry for the confusion.
